The full bench of the Fair Work Commission has upheld a ruling that BHP Billiton must reinstate an employee at its Mount Arthur coal mine who was sacked for making offensive comments about Muslims. The majority of commissioners supported the view of their colleague who presided over the original case and had concluded that the comments would have been more serious if they had been specifically made to Muslims working at the mine rather than employees in general.
